Guest Agreement & Privacy Statement
Westend Podcast Guest Agreement
This agreement is made between Westend Podcast (“Podcast Host”) and the guest (“Guest”) regarding their participation in a podcast episode. By participating in the podcast, the Guest agrees to the terms outlined below.
1. Recording & Usage Rights
1.1 The Podcast Host will record, edit, and distribute the episode featuring the Guest across various platforms, including but not limited to streaming services, websites, and social media.
1.2 The Guest grants the Podcast Host the non-exclusive, royalty-free, perpetual right to use, distribute, edit, and promote the recorded content in any media format, including audio, video, and written transcripts.
1.3 The Podcast Host retains full creative control over the final content, including editing, marketing, and promotional materials.
2. Copyright & Intellectual Property
2.1 The Podcast Host owns the copyright to the podcast episode, including all recorded audio and video.
2.2 The Guest may share, promote, and reference their episode but may not modify, sell, or republish it without prior written consent from the Podcast Host.
2.3 If the Guest provides any original content (e.g., music, quotes, or written work), they confirm that they own or have permission to use such content.
3. Guest Responsibilities & Duty of Care
3.1 The Guest agrees to provide truthful and accurate information during the podcast discussion.
3.2 The Guest acknowledges that their opinions are their own, and they assume full responsibility for any statements made during the recording.
3.3 The Podcast Host is not liable for any consequences resulting from the Guest’s statements or opinions expressed during the episode.
3.4 The Podcast Host agrees to conduct interviews in a professional manner, ensuring a respectful and inclusive environment for all guests.
4. Privacy & Confidentiality
4.1 Any sensitive or off-the-record discussions before or after recording will be kept confidential unless otherwise agreed upon.
4.2 The Guest acknowledges that the podcast episode will be publicly available and may be used for promotional purposes.
4.3 If the Guest requests the removal of an episode, the Podcast Host will review the request but is not obligated to comply.
5. Indemnification & Release
5.1 The Guest releases and discharges the Podcast Host from any claims, demands, or causes of action arising out of their participation in the podcast.
5.2 The Guest agrees to indemnify and hold harmless the Podcast Host from any liabilities or legal issues resulting from their statements or shared content.
6. Governing Law & Agreement Acceptance
6.1 This Agreement shall be governed by the laws of Victoria, Australia.
6.2 By participating in the podcast, the Guest agrees to the terms outlined in this Agreement.
